The survey, conducted by Pineda Consulting, polled 1,003 voters nationwide and found that, regardless of political party, voters feel vulnerable to identity theft, especially when they go online. Ninety-seven percent of voters believe that identity theft is a "serious problem" and 71 percent believe that new laws are needed to deal with the threat. Voters believe that these new laws should be created at the national level. Sixty percent feel that it is the federal government and not state legislatures that should take the lead in protecting Americans from identity theft, while 61 percent of all voters (64 percent Democrat/ 55 percent Republican) feel that it is the responsibility of the federal government, not market forces, to protect them against identity theft. When asked what steps they want Congress to take to stem the tide of identity theft, voters, although they express favorable attitudes towards all remedies, prefer stiffer penalties and stronger enforcement over technological solutions or greater disclosure. Many prefer to make spyware a criminal offense punishable by a fine or 2 years in prison. It is interesting to note that, even as voters clamor for Congressional action, they have very little faith that Congress will act. Those who describe themselves as Internet experts, however, do express a higher level of confidence in the safety of their online purchases. Sixty three percent feel confident, while only 30 percent avoid making purchases. Among self described novices, that number drops to 27 percent that express confidence versus 65 percent who avoid making purchases. The results of this poll indicate an unmistakable public attitude.
